The Regulatory System: Law, Regulator, Permit, Operator

How the four parts of environmental regulation connect, and where a compliance manager sits.

Environmental permitting looks like paperwork, but it is a system with four parts. Law sets the duties and the offences. A regulator is given powers by that law to issue permits, inspect and enforce. The permit applies the law to one site and one operation. The operator is the legal person — usually a company — that holds the permit and must comply with it.

This course is for people who manage that compliance day to day: environmental advisers, site and operations managers, and engineers responsible for plant covered by a permit. It assumes you know the basics of environmental aspects and pollution control, and it focuses on applying permit requirements in a real operation.

The four parts in more detail

Why the structure matters in practice

Case 1: two regulators, one drain. A food factory held an environmental permit for its boilers and a trade effluent consent from the local sewerage company. The compliance team tracked the permit carefully but treated the effluent consent as a utility contract. When a cleaning chemical changed, the effluent breached its consent limit for chemical oxygen demand. The sewerage company, not the environmental agency, took action. The fix was to put every authorisation — whichever body issued it — into one register.

Case 2: who is the operator? A manufacturer handed the running of its wastewater plant to a specialist contractor. The permit stayed in the manufacturer's name. When the contractor let a sludge tank overflow, the regulator treated the manufacturer as the operator responsible, because it still held the permit and controlled the site.

A company outsources its effluent plant to a contractor but keeps the permit in its own name. A breach happens. Who does the regulator usually look to first?
